These Terms & Conditions (“Terms”) govern your use of memulo.co.za (the “Site”) and any purchase, pre-order, or enquiry made through it. The Site is operated by MEMULO HOLDINGS (PTY) LTD (registration number 2026/132134/07), a company registered in South Africa (“Memulo”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. Products, direct sale and pre-orders
Products on the Site fall into two categories, clearly marked on each product page:
- Buy now (direct sale) — currently the Cullinan kettle and Cullinan toaster. These can be purchased immediately, paid for in full at checkout, and are dispatched once payment clears.
- Pre-order — all other products (including the Toniic and Magna Earth ranges). Submitting a pre-order is an expression of interest and reservation only. No payment is collected at pre-order stage, and no contract of sale is formed until Memulo separately confirms pricing, lead time and availability with you and you agree to proceed.
We reserve the right to limit quantities, refuse an order, or correct pricing/description errors before dispatch. If we cancel a paid order, you will receive a full refund.
3. Pricing and payment
All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable, unless stated otherwise. Direct-sale payments are processed securely by PayFast (Pty) Ltd, an independent, PCI-DSS compliant payment gateway. Memulo does not store your card details. Payment terms, security and dispute processes for the payment itself are governed by PayFast's own terms, available at payfast.co.za.
4. Delivery, risk and title
Estimated delivery timeframes are provided at checkout or by our team and are not guaranteed. Risk in goods passes to you on delivery; title passes once payment has been received in full. International orders may be subject to import duties, taxes and customs clearance charges payable by the recipient.
5. Your right to cancel, return and be refunded (Consumer Protection Act)
In line with the South African Consumer Protection Act 68 of 2008 (“CPA”) and general international consumer-protection standards (including a minimum cooling-off period comparable to the EU/UK Consumer Contracts Regulations), you may cancel a direct-sale order and return the goods, unused and in original packaging, within 7 (seven) calendar days of delivery for a full refund of the purchase price, excluding original delivery costs. This right does not apply to goods that have been used, damaged, or are not in a resaleable condition.
Where goods are defective, unsafe, or not of good quality as required by the CPA, you are entitled to a repair, replacement or refund at your election within six months of delivery, at no charge to you, in addition to any manufacturer warranty.

6. Privacy and personal information (POPIA)
We process your personal information (name, contact details, delivery address, order and communication history) in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and, for visitors from the EU/UK, in a manner consistent with GDPR principles of lawfulness, purpose limitation, data minimisation and security.
We collect and use your information only to:
- process orders, pre-orders and enquiries, and communicate with you about them;
- provide customer support (including via WhatsApp — see section 7 below);
- meet legal, tax and accounting obligations; and
- improve the Site and, where you have opted in, send you marketing updates.
Your information is stored on secure infrastructure and is not sold to third parties. It is shared only with service providers strictly necessary to fulfil your order (such as our payment processor and delivery partners) or where required by law.
You have the right to access, correct, or request deletion of your personal information, to object to or restrict certain processing, and to lodge a complaint with the Information Regulator (South Africa) at inforegulator.org.za. 7. WhatsApp and electronic communications (WABA)
If you provide a WhatsApp number when placing an order, submitting a pre-order, or messaging us, you consent to receive transactional messages from Memulo over WhatsApp Business Messaging (order confirmations, pre-order updates, delivery notices and replies to your enquiries), in line with WhatsApp's Business Messaging Policy and Meta's commerce policies. We do not send unsolicited marketing messages over WhatsApp unless you have separately opted in, and you may opt out of non-transactional messages at any time by replying “STOP” or contacting us at hello@memulo.co.za. Standard messaging rates from your network provider may apply.
8. Access to information (PAIA)
In accordance with the Promotion of Access to Information Act 2 of 2000 (PAIA), you may request access to records held by Memulo by writing to our Information Officer at hello@memulo.co.za. We will respond within the statutory timeframes prescribed by PAIA. A fee may apply for the reproduction of records, as prescribed by the Regulations to PAIA.
9. International customers
Memulo sells to customers outside South Africa. Nothing in these Terms limits any mandatory consumer-protection rights you have under the law of your own country of residence, including (where applicable) rights under the EU/UK Consumer Rights Directives or your local equivalent, and rights to seek resolution through your local consumer authority or an Online Dispute Resolution (ODR) platform where available. Where local law grants you stronger protection than section 5 above, the stronger protection applies.
10. Intellectual property
All content on the Site — including the Memulo name, logo, range names (Toniic, Magna Earth, Cullinan), product designs, photography and copy — is owned by or licensed to Memulo Holdings (Pty) Ltd and may not be reproduced without our written permission.
11. Limitation of liability
To the maximum extent permitted by law, Memulo's liability for any claim arising from your use of the Site or a purchase is limited to the amount you paid for the relevant order. Nothing in these Terms limits liability that cannot be excluded under the CPA or other applicable law, including liability for gross negligence or for defective, unsafe goods.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. South African customers may refer unresolved disputes to the National Consumer Commission or the applicable Consumer Goods and Services Ombud. International customers may also rely on any mandatory dispute-resolution rights available in their own jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business or the law. The version in effect at the time of your order applies to that order. Material changes will be reflected by updating the “Last updated” date above.
